The following Terms and Conditions apply to anyone using a Cash Cow account and you are personally responsible for the consequences that may result if anyone using your account breaks any of the rules herein.
By registering with Cash Cow Arcade.com (hereinafter “Cash Cow”), you will open an account with Cash Cow in the United States. Your data will be stored in the USA and is protected by our Privacy Policy. Our affiliates and we typically use your data to administer your account, provide information of interest to you, and to communicate with you. By registering for a Cash Cow account, you agree that Cash Cow may process your data in accordance with the following Privacy Policy and that you will abide by Terms & Conditions below.
Privacy Policy and Personal Information
Cash Cow and its parent and subsidiary companies respect your and have adopted a privacy policy that reflects how we utilize any personal information we receive.
If you click on a link to a third-party site, such as an advertisement, you will leave the Cash Cow site. Cash Cow is not responsible for what you may do on that third-party site and what information you may divulge to them, nor are we responsible for what that third party may do with your information. We encourage you to review that site’s privacy policy before providing them with any personal information.
The information we may collect from you depends on your level of activity on our site, but may include, but not limited to, your name, IP address, e-mail address, phone number, mobile number, home address, birth date, and social security number (or other government ID# if not in the USA). Prizewinners, in particular, will be required to provide Social Security or Social Identification Number for tax purposes. Whatever the purpose may be, we will only collect information to the extent reasonably necessary to fulfill your requests and our legitimate business objectives.
We do not require personal information to obtain access to any of our sites; however, you will not be able to access certain areas that require registration and/or premium membership.
Cash Cow may use personal information as a means to alert you to new features, contests and products we feel you may be interested in. For example, we may send an email regarding a product or service of a third party.
For members under the age of 18, we will not disclose any personal information about them to third parties.
If for any reason you are concerned about Cash Cow’s possession of your personal information, you may have your account(s) deactivated and removed from our database. By using this site, you signify your assent our privacy policy contained within this document. We reserve the right to make changes in this policy at any time. Violation of any of our Terms and Conditions, and/or our Official Rules, may result in a warning or termination without notice of any and all accounts you may have.
Cash Cow Store
Visitors claiming prizes from through our online store need to provide their name, mailing address, telephone number and e-mail address. Our online store stores may employ third-party contractors, such as Paypal, whose personal information requirements may differ from ours.
Online Chat Rooms and Profiles
You may choose to disclose information about yourself in our online chatrooms or in create user “profiles” when you play games on our sites. Information that you disclose in chat rooms or in “profile” information is public information, and there is no expectation of privacy or confidentiality in either place. Please see our Official Rules on this point and for other guidelines about posting content on our web sites.
Children
For children under the age of 12, no accounts should be created and no information should be submitted nor posted to the Cash Cow online site. If a parent or legal guardian wishes to allow their child under 12 to have an account, we require prior written permission or other verifiable consent from a parent or guardian. Upon registration, the account will be made available for use. This form must be signed by the child's parent or guardian and returned to Cash Cow Arcade by mail to Gamers Guides LLC, ATTN: Cash Cow Consent, 3504-261 Highway 153, Greenville, SC 29611 USA. Once we have obtained parental consent, parents should be aware that we are not able to prohibit that child’s participation in any portion of our site nor control what personal information that child may disclose.
If for any reason you are concerned that your child's personally identifiable information maintained by Cash Cow is not correct or complete, should you wish to have your child's personal information deleted from our records, or if you want Cash Cow to discontinue further collection or use of your child's personal information, please contact us by mail to Gamers Guides LLC, ATTN: Cash Cow Privacy, 3504-261 Highway 153, Greenville, SC 29611 USA and we will be happy to review, update or remove your child's information as appropriate.
If for any reason you are concerned about Cash Cow’s possession of your child’s personal information, you may have his or her account(s) deactivated and removed from our Database. Account Registration
When you register an account with Cash Cow, you become a Cash Cow Member, which allows you to participate in certain games and activities on Cash Cow Arcade. A user’s login name must be unique to other users of the site and it cannot be offensive or used in a way that violates our Terms and Conditions. You must be truthful with the information you provide upon registration.
Do not reveal your password to other users. Cash Cow will never ask you to reveal your password. If any improper or illegal use of your account occurs, you agree to indemnify and hold Cash Cow harmless for any improper or illegal use of your account. This includes illegal or improper use by someone to whom you have given permission to use your Account. Your Account is at risk of termination if anyone uses it in a way that violates our Terms and Conditions.
Charges and Billing
You may have a Cash Cow Arcade account without paying any money and may participate in games and other activities. For Premium Membership, Cash Cow Arcade charges subscription fees to allow access to certain areas of the site, premium game content, and other activities relegated to Premium Members . You must have a Cash Cow Arcade account and pay the subscription fee to participate in Premium activities. Once you have become a Premium Member, that information will be displayed in your user profile.
All subscription fees are payable in advance and are not refundable in whole or in part. Cash Cow Arcade reserves the right to change its fees or billing methods at any time. If any change is made to the monthly subscription service, Cash Cow Arcade will notify you of the change at least 30 days in advance. You are responsible for reviewing Cash Cow Arcade for notice of such changes. If you continue to use your Premium Membership service after 30 days of posting of the changes, this will mean that you accept those changes and agree to the new subscription rate. If the changes are unacceptable, you may cancel your subscription at any time. Cash Cow will not prorate any portion of any time left on your monthly subscription should you choose to cancel.
You may pay for subscriptions via PayPal or with check/cash/money order via US Mail. Subscriptions paid via Paypal will automatically renew per the term chose, either monthly or yearly, unless you cancel your subscription. Subscriptions paid via US Mail should be payable to Gamers Guides and sent to the following address: Gamers Guides LLC, ATTN: Cash Cow Subscriptions, 3504-261 Highway 153, Greenville, SC 29611 USA. If you choose to pay by mail, your account will be active for 30 days from the date of receipt of payment. Unless additional funds are received for future month(s) subscription, the user’s account will revert back to a regular, non-premium member.
The account holder is responsible for all charges incurred, including applicable taxes, and all purchases made by you or anyone that uses your account.
Both Cash Cow Arcade and you have the right to terminate or cancel your account or subscription at any time. Cancellation of your account or subscription is your sole right and remedy with respect to any and all disputes you may ever have with Cash Cow Arcade.
You can cancel your Account or a particular subscription by delivering notice to Cash Cow Arcade via PM to one of the Admins or by US Mail to Gamers Guides LLC, ATTN: Cash Cow Cancellation, 3504-261 Highway 153, Greenville, SC 29611 USA. In the event that your account is terminated or canceled, no reimbursements or refunds will be granted and no online time or Cow Points will be credited to you, and you will have no further access to your account or anything within Cash Cow Arcade.
Communication is not Private
Any communication on the Cash Cow website is not private and you should have no expectation of privacy. We encourage you not to disclose any personal information on the website. Cash Cow is not responsible for information that you choose to divulge to other users of Cash Cow. Any content that you post to the site becomes the property of Cash Cow Arcade and we have the right to use, modify and distribute that content in any way we see fit.
You may not advertise any goods or services on Cash Cow Arcade. Chain letters and pyramid schemes are forbidden, as is the sending of unsolicited emails to other members. Any violation of these provisions can subject your Cash Cow account(s) to immediate termination and possible legal action.
Use of automated systems
The use of any automated system, hack, script, 3rd-party program, and the like on the Cash Cow site is strictly prohibited and may result in criminal liability under the Computer Fraud and Abuse Act, Section 1030 of the United States Code and/or under applicable laws in other jurisdictions. You may only play our games with one internet browser at a time. Cash Cow may terminate the accounts of anyone who, in our sole discretion, determines has violated this rule or any other rule in our Terms and Conditions. All decisions by Cash Cow are final.
Copyrights and Trademarks
The content on Cash Cow Arcade.com is owned by Cash Cow or our licensors, and therefore protected by copyrights, trademarks, and other intellectual property rights. It is forbidden to copy or download any thing from our site without express permission from Cash Cow to do so. Violation of this rule may result in termination of your account, forfeiture of all Cow Points and other earnings, and possible legal action.
Indemnification and Liability
Neither Cash Cow nor its Licensors have any liability in connection with your use of our site, including consequential or incidental damage to your computer or software, and you bear the entire risk of use.
Upon request by Cash Cow, you agree to defend, indemnify and hold harmless Cash Cow and its affiliates, subsidiaries, employees, contractors, officers, directors, vendors, and content providers from all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of these Terms and Conditions for which you are responsible or in connection with your transmission of any content on Cash Cow. Cash Cow reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification to Cash Cow in that matter. This section shall survive termination of this Agreement.
Other
Cash Cow maintains a database that contains users IP Addresses. Typically use of IP addresses is limited. However, Cash Cow may use them to personally identify you in order to enforce our Terms and Conditions and block that user’s IP address if in Cash Cow’s opinion that user has violated the Cash Cow Terms and Conditions.
The Cash Cow Terms and Conditions are not intended to confer and do not confer any rights or remedies upon any person other than the parties to this agreement. This document is not intended to confer, nor does it confer, any rights or remedies upon any person. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
